Overview

What are Propositions LL and MM?

There are two statewide measures on the ballot in Colorado for November 4, 2025—Proposition LL and Proposition MM. Both relate to the state's Healthy School Meals for All Program (HSMA), which reimburses public schools for providing free breakfast and lunch to students.[1][2]

In 2022, voters approved Proposition FF, which created the HSMA and, to fund the program, reduced state income tax deductions for taxpayers with a federal adjusted gross income above $300,000.

Proposition LL: In 2022, the legislature’s fiscal analysis projected that the reduced income tax deductions from Proposition FF would generate $100.7 million for the HSMA. However, the tax changes generated $112.0 million—$11.3 million more than the estimated amount.[3]

Under Colorado's Taxpayer's Bill of Rights (TABOR), revenue collected above the estimated amount, plus 10% interest, must be refunded to taxpayers and adjustments made to tax rates, unless voters approve another ballot measure allowing the state to keep the excess revenue. Proposition LL is that measure. Approval of Proposition LL would enable the state to keep $12.4 million in excess revenue and interest, along with future revenue from reduced income tax deductions, to provide funding for the Healthy School Meals for All Program.[1]

Proposition MM: This ballot measure would further reduce the state income tax deductions for taxpayers with a federal adjusted gross income above $300,000 from $12,000 to $1,000 for single filers and $16,000 to $2,000 for joint filers. This reduction would generate an estimated $95 million in revenue for the HSMA and, once the program is funded and reserves reach 35%, to provide funding for the Supplemental Nutrition Assistance Program (SNAP). The Legislative Council Staff estimated that taxpayers earning over $300,000 would be taxed about $327 more for single filers and $574 more for joint filers.[1][2][4]

How would the election results for the two ballot measures interact?

Together, Propositions LL and MM would increase funding for the Healthy School Meals for All Program. However, voters could approve one measure and reject the other, leading to different funding outcomes. Rejection of both measures would limit the program to eligible low-income schools and, at other schools, eligible low-income students. How did the legislature vote on the ballot measures?

Propositions LL and MM were placed on the ballot through the passage of House Bill 1274 (HB 1274). In the Senate, the vote was 24-11. In the House of Representatives, the vote was 42-22. Legislative Democrats supported HB 1274. Most Republicans (33 of 34) voted against the legislation. Gov. Jared Polis (D) signed the bill on June 3, 2025.[1]

An earlier version of Proposition MM would have directed revenue from the reduction in state income tax deductions to the HSMA, without funding for SNAP. However, in August, Gov. Jared Polis (D) called a special legislative session in response to H.R. 1, also known as the One Big Beautiful Bill Act.[5] H.R. 1 was a federal budget reconciliation bill that addressed various tax and spending matters, which included reducing federal funding for SNAP. The Colorado General Assembly, during this special legislative session, amended Proposition MM to allow for some of this new revenue to be directed to SNAP after HSMA is funded and reserves reach 35%.[2]

Without raising taxes, may the state keep and spend all revenue generated by the 2022 voter-approved state tax deduction limits on individuals with incomes of $300,000 or more and maintain these deduction limits in order to continue funding the Healthy School Meals for All program, which pays for public schools to offer free breakfast and lunch to all students in kindergarten through twelfth grade?[6]

Background

Proposition FF (2022)

Proposition FF was on the November 2022 ballot and was approved with 57% of voters in favor and 43% opposed. The measure reduced state income tax deduction limits for those earning $300,000 or more from $30,000 for single filers and $60,000 for joint filers to $12,000 for single filers and $16,000 for joint filers. Proposition FF created the Healthy School Meals for All Program and allocated revenue from the deduction change to fund it. The program reimburses participating schools to provide free meals to students and provide schools with local food purchasing grants and school food-related funding.

Proposition FF was estimated to increase state revenue by $100,727,820 annually.

Supporters and opponents of Proposition FF

Healthy School Meals for All Colorado Students led the campaign in support of Proposition FF. Healthy School Meals for All and Hunger Free Colorado said, "The free and reduced-price meals program income threshold is too low to truly account for children and families facing food insecurity. School Meals for All would eliminate lunch debts so families can focus on other needs like housing, utilities, and more. It would also prevent students from feeling stigma or shame when their families can't pay for lunch. The ballot initiative would raise $100 million per year to cover the costs of the program through the closure of tax loopholes for high-income earners."[8]

Opponents of Proposition FF included the Independence Institute. Jon Caldara, president of the Independence Institute, said, "This is a really stupid idea. This proposal is, hey, let's get the rich guys to buy our kids lunch."[9] State Representative Richard Holtorf (R), who voted against the bill in the state House, said, "My kids are all grown, but if I had kids, how can I sit here and say my kids should have a free lunch if I’m making six figures? I don’t think that’s right. So I have a fundamental problem with the premise of the bill. People that could afford to pay need to pay to subsidize programs needed to help the people who need the subsidies."[10]

Healthy School Meals for All programs

As of April 2025, Colorado was one of eight states to adopt a program providing school meals to students free of cost, regardless of income. The other seven states include California, Maine, Massachusetts, Michigan, Minnesota, New Mexico, and Vermont.[11]

Recent revenue retention measures

Revenue retention measures ask voters whether the state can retain and spend revenue collected above the original amount approved by voters. Recent revenue retention measures were on the ballot in Colorado in 2023 and 2024, and both were approved.

2024: Voters approved Proposition JJ, which allowed the state to retain tax revenue collected above $29 million annually from the tax on sports betting proceeds authorized by voters through Proposition DD in 2019.

2023: Voters approved Proposition II, which allowed the state to keep and spend revenue exceeding official projections from increased taxes on cigarettes, tobacco, and nicotine products, which voters approved as Proposition EE in 2020.

A simple majority vote is required during one legislative session for the Colorado State Legislature to place a state statute on the ballot. That amounts to a minimum of 33 votes in the Colorado House of Representatives and 18 votes in the Colorado State Senate, assuming no vacancies. Statutes do not require the governor's signature to be referred to the ballot.

The Colorado Taxpayer's Bill of Rights (TABOR) requires voter approval for new taxes, tax rate increases, extensions of expiring taxes, mill levy increases, valuation for property assessment increases, or tax policy changes resulting in increased tax revenue.

  17. Under federal law, the national mail voter registration application (a version of which is in use in all states with voter registration systems) requires applicants to indicate that they are U.S. citizens in order to complete an application to vote in state or federal elections, but does not require voters to provide documentary proof of citizenship. According to the U.S. Department of Justice, the application "may require only the minimum amount of information necessary to prevent duplicate voter registrations and permit State officials both to determine the eligibility of the applicant to vote and to administer the voting process."
