South Carolina state legislative special elections, 2013
Three special elections were scheduled for the South Carolina State Legislature in 2013. These elections were called to fill vacancies in the South Carolina State Senate District 42 and the South Carolina House of Representatives Districts 17 and 93.
How vacancies are filled
If there is a vacancy in the South Carolina Legislature, the presiding officer of the chamber in which the vacancy happens must call for a special election. If candidates plan to seek the nomination through a political party primary or a political party convention, the filing period begins on the third Friday after the vacancy occurs. The qualifying deadline is eight days after the filing period opens.[1]
If a candidate plans to seek the nomination via petition, all signatures must be submitted to the appropriate filing officer no later than 60 days before the election. All signatures must be verified by the filing officer no later than 45 days before the election.[2]
A primary election must be held on the eleventh Tuesday after the vacancy occurs. If necessary, a primary runoff must be held on the thirteenth Tuesday after the vacancy occurs. The special election is held on the twentieth Tuesday after the vacancy occurs. If the twentieth Tuesday after the vacancy occurs is less than 60 days prior to the general election, the special election must be held on the same day as the general election.[2][3]

Tom Corbin (R) resigned his District 17 seat in the South Carolina House of Representatives on November 12, 2012, after he won election to both the House and the state Senate on November 6. A special election was scheduled for March 12, 2013. Candidates had until December 10, 2012 to file. A Republican primary was held on January 11, 2013. Mike Burns missed winning outright by one vote and went to a runoff with Chris Sullivan, which Burns won. Since no write-in Democrat filed to run by February 21, Burns was declared the winner on March 12.[4][5][6][7] |

Sen. Robert Ford (D) resigned on May 31, 2013 amidst an ethics investigation. A special election was called for October 1, with a primary on August 13. The filing period for candidates ran from June 21 to July 1.[8][9][10][11]

Rep. Harry Ott, Jr. (D) resigned on July 20, 2013 to work as the state director for the Farm Service Agency in the federal government. A special election was called for October 29. The filing period for candidates ran from July 12 to July 26.[12][13]
