The Washington Court of Appeals is the intermediate appellate court for the state of Washington. The court is a non-discretionary appellate court. This means that it must accept, review and issue a written decision for all appeals filed with it, unlike the Washington State Supreme Court, which can reject an appeal.

There are 22 judges on the Court of Appeals. The court is divided into three divisions: Division 1 (10 judges) is based in Seattle, Division 2 (seven judges) is based in Tacoma, and Division 3 (five judges) is based in Spokane. Cases are heard by a panel of three judges from the division to which it is appealed. There is no en banc review available for a division or the entire Court of Appeals. Judges from one division may serve as a pro tem visiting judge on another division.[1]

In 2025, the associate judges of the court received a salary of $249,417, according to the National Center for State Courts.[3]

Judicial selection

The 22 judges of the Washington Court of Appeals are selected through contested nonpartisan elections and must run for re-election when their terms expire. Appeals court judges serve for six years.[4]

Qualifications

To serve on the court of appeals, a judge must be:

  • a resident of his or her district for at least one year;
  • admitted to practice law in the Washington courts for at least five years[5]

Presiding chief judge

The presiding chief judge for all three divisions is chosen through a peer vote and has a set term of one year.[6]

Vacancies

In the event of a midterm vacancy, the governor appoints a replacement. The appointee serves until the next general election, at which point he or she may run to serve for the remainder of the predecessor's term.[7] If the resignation and subsequent appointment takes place after the filing period opens for that year's elections, the appointee must stand in the next year's election to remain on the bench.

Ethics

The Washington Code of Judicial Conduct sets forth ethical guidelines and principles for the conduct of judges and judicial candidates in Washington. It consists of four canons:

  • Canon 1: "A Judge Shall Uphold and Promote the Independence, Integrity, and Impartiality of the Judiciary, and Shall Avoid Impropriety and the Appearance of Impropriety"
  • Canon 2: "A Judge Should Perform the Duties of Judicial Office Impartially, Competently, and Diligently"
  • Canon 3: "A Judge Shall Conduct the Judge’s Personal and Extrajudicial Activities to Minimize the Risk of Conflict with the Obligations of Judicial Office"
  • Canon 4: "A Judge or Candidate for Judicial Office Shall not Engage in Political or Campaign Activity that is Inconsistent with the Independence, Integrity, or Impartiality of the Judiciary"[8]

Removal of judges

Judges in Washington may be removed in one of two ways:

  • By the supreme court after an investigation by the commission on judicial conduct; an investigation may be sparked by a complaint of judicial misconduct or because of judicial disability. The commission holds a hearing and evaluates a case, after which it may recommend supreme court action.[9]
  • By a joint resolution of the legislature, with the consent of three-fourths of each house.[10]

Washington voted for the Democratic candidate in all seven presidential elections between 2000 and 2024.

Pivot Counties (2016)

Ballotpedia identified 206 counties that voted for Donald Trump (R) in 2016 after voting for Barack Obama (D) in 2008 and 2012. Collectively, Trump won these Pivot Counties by more than 580,000 votes. Of these 206 counties, five are located in Washington, accounting for 2.43 percent of the total pivot counties.[12]

Pivot Counties (2020)

In 2020, Ballotpedia re-examined the 206 Pivot Counties to view their voting patterns following that year's presidential election. Ballotpedia defined those won by Trump won as Retained Pivot Counties and those won by Joe Biden (D) as Boomerang Pivot Counties. Nationwide, there were 181 Retained Pivot Counties and 25 Boomerang Pivot Counties. Washington had four Retained Pivot Counties and one Boomerang Pivot County, accounting for 2.21 and 4.00 percent of all Retained and Boomerang Pivot Counties, respectively.
