Montalvo was nominated by President George W. Bush on May 1, 2003, to a new seat on the United States District Court for the Western District of Texas created by 116 Stat. 1758. The American Bar Association rated Montalvo Unanimously Well Qualified for the nomination. Hearings on Montalvo's nomination were held before the Senate Judiciary Committee on July 9, 2003, and his nomination was reported by U.S. Sen. Orrin Hatch (R-Utah) on July 17, 2003. Montalvo was confirmed on a recorded 95-0 vote of the U.S. Senate on July 31, 2003, and he received his commission the next day.[2][3][4]
