Diane L. Kroupa is a former Article I federal judge for the United States Tax Court. She joined the court in 2003 after a nomination from President George W. Bush (R). On June 16, 2014, she retired from the U.S. Tax Court.

On April 4, 2016, Kroupa and her husband, Robert Fackler, were indicted by the U.S. Department of Justice on charges of "conspiracy, tax evasion, making and subscribing false tax returns and obstruction of an Internal Revenue Service (IRS) audit."[1][2][3]

Education

Kroupa earned a B.S.F.S. from Georgetown University in 1978 and a J.D. from the University of South Dakota Law School in 1981.[3]

Tax Court

Kroupa was nominated to the United States Tax Court by President George W. Bush and was confirmed by the U.S. Senate. She joined the court on June 13, 2003. She retired from the court on June 16, 2014.[3]

Justice Department indictment

On April 4, 2016, Kroupa and her husband, Robert Fackler, were indicted by the U.S. Department of Justice on charges of "conspiracy, tax evasion, making and subscribing false tax returns and obstruction of an Internal Revenue Service (IRS) audit."[1] The indictment alleges that between 2004 and 2014—during Kroupa's tenure on the U.S. Tax Court—she and her husband deliberately concealed income earnings of one million dollars, on which they failed to pay nearly $400,000 in income taxes. If convicted, Kroupa faces a maximum sentence of 4.5 years in prison.[4]
