James Rosenbaum
James Michael Rosenbaum (b. 1944) is a former Article III federal judge for the United States District Court for the District of Minnesota. He joined the court in 1985 after being nominated by President Ronald Reagan. Rosenbaum stepped down from the court on August 25, 2010.[1][2]
Early life and education
Rosenbaum, who is a native Minnesotan, graduated from the University of Minnesota-Twin Cities with his bachelor's degree in 1966 and his juris doctorate in 1969.[2]
Professional career
Rosenbaum started his legal career in Chicago as an attorney for VISTA from 1969 to 1970 and for the Leadership Council for the Metropolitan Open Communities-Chicago Branch from 1970 to 1972. In 1973, Rosenbaum moved back to Minnesota to enter into private practice in Minneapolis/St. Paul. He served there until 1981 when he was appointed by President Ronald Reagan as the US Attorney for the District of Minnesota.[2]
Judicial nominations and appointments
District of Minnesota
On the recommendation of Senators Rudy Boschowitz and David Durenberger, Rosenbaum was nominated to the United States District Court for the District of Minnesota by President Ronald Reagan on June 14, 1985 to a new judgeship created by 98 Stat. 333 which was approved by Congress. Rosenbaum was confirmed by the U.S. Senate on July 16, 1985 on a senate vote and received commission on July 18, 1985. Rosenbaum served as the chief judge of the District of Minnesota from 2001 to 2008 and assumed senior status on October 26, 2009. He continued serving the court as a senior judge until his retirement on August 25, 2010.[2] Rosenbaum was succeeded in this position by Susan Richard Nelson.
Noteworthy cases
Paraplegic prisoner case
On September 10, 2009 Judge Rosenbaum dismissed a motion by the Olmstead County Sheriff's office to throw out a lawsuit filed by a former inmate David Schaub who was paraplegic. In 2007 Schaub sued the sheriff's office for failing to address his medical needs when he was held in the jail in 2003. The judge found that there is enough evidence for a jury to decide if the county is liable.[3]
UnitedHealth settlement
On August 11, 2009, Judge Rosenbaum approved a class-action settlement between the California Public Employees Retirement System and UnitedHealth Care's senior management. The retirement system for California state employees sued United Health in 2006 over the backdating of stock options as part of California employee's retirement package. The Minnesota-based health insurance company will pay $895 million dollars in damages while former United Health CEO William McGuire will pay $30 million and forfeit 3.6 million shares in stock options.[4]
Resignation
Judge Rosenbaum wrote a letter to his colleagues in the District of Minnesota federal court regarding his plan to retire in August of 2010. He said: "serving this past quarter-century as a federal judge, and for the preceding four years as United States Attorney, has been an extraordinary honor and a professional pleasure...I have always been impressed with the quality, competence, talent, and professionalism of Minnesota's federal employees. Thank you all so much for your help and willingness to assist me as I have worked to fulfill my duties."
Rosenbaum said he plans to enter into alternate dispute resolution and work on complex legal issues as the next steps in his legal career.[1]
